WHEN THIS PROCEDURE APPLIES

This procedure applies to former Italian citizens who lost their Italian citizenship before August 16, 1992, and who intend to reacquire it by filing a declaration with the Consular Office or by subsequent residence in Italy.

Reacquisition may occur in one of the following ways:

  • By filing a declaration with the Consular Office, pursuant to Article 13, paragraph 1, letter c), Law 91/1992; in this case, the interested party must transfer their permanent residence to Italy within one year of the declaration;
  • By residing in Italy for at least one continuous year, pursuant to Article 13, paragraph 1, letter d), Law 91/1992. In this second case, a consular declaration is not required.

 

This section concerns exclusively the first option, i.e., reacquisition by filing a declaration pursuant to Article 13, paragraph 1, letter c), Law 91/1992.

Please note that failure to transfer residence to Italy within one year of filing the declaration will render the declaration invalid.
