Recognition under of Italian Citizenship according to Special Legislation

Law No. 379 of December 14, 2000, provides for the recognition of Italian citizenship to people  born and residing within the territories of the former Austro-Hungarian Empire and their descendants provided that they meet the necessary requirements.

The deadline for applying Law No. 379/2000 expired on December 19, 2010.

Law No. 124 of March 8, 2006, provides for the recognition of Italian citizenship in favor of compatriots who lost it for having resided in Istria, Fiume, and Dalmatia from 1940 to 1947.

Recognition of Italian citizenship according to special legislation constitutes the acquisition of Italian citizenship “by benefit of the law”: therefore, a citizen parent cannot make the declaration of intent to acquire citizenship for their minor child, as required by Article 4, paragraph 1-bis, of Law No. 91/1992, since the recognized parent is not an Italian citizen by birth.
