SECOND CASE: Article 1, Paragraph 1-ter of Decree-Law No. 36/2025

This is a temporary provision and applies where ALL of the following conditions are met:

  • The individual was a minor as of the date of entry into force of the conversion law, that is, had not yet reached the age of 18 on May 24, 2025;
  • The individual is the child of citizens by birth who fall within the situations set forth in letters a), abis), and b) of Article 3-bis of Law No. 91/1992. In other words, the parents must have been recognized as citizens on the basis of an administrative or judicial application submitted no later than I I p.m. (Rome time) on March 27, 2025, or on the basis of an application submitted pursuant to an appointment communicated by the Consular Office or the Municipality no later than the same date;
  • The declaration of the parents or guardian must be submitted to the Consular Office no later than May 3 1, 2026. Should the applicant, who was a minor on May 24, 2025, reach the age of majority before this deadline, the declaration must be submitted personally by the applicant within the same timeframe.

Declarations must be made in person before the Consular Office, in the presence of officials delegated to perform civil status functions.
