{"id":15005,"date":"2026-03-27T15:42:20","date_gmt":"2026-03-27T19:42:20","guid":{"rendered":"https:\/\/ambwashingtondc.esteri.it\/servizi-consolari-e-visti\/servizi-per-il-cittadino-straniero\/cittadinanza-2\/cittadinanza-italiana-per-matrimonio\/quando-si-applica-questa-procedura\/"},"modified":"2026-03-30T12:43:12","modified_gmt":"2026-03-30T16:43:12","slug":"quando-si-applica-questa-procedura","status":"publish","type":"page","link":"https:\/\/ambwashingtondc.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-straniero\/cittadinanza-2\/cittadinanza-italiana-per-matrimonio\/quando-si-applica-questa-procedura\/","title":{"rendered":"WHEN DOES THIS PROCEDURE APPLY?"},"content":{"rendered":"<p>The acquisition of Italian citizenship by a foreign or stateless spouse who married an Italian citizen on or after April 27, 1983, is currently regulated by <a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:legge:1992;91\">Law No. 91 of February 5, 1992<\/a> (Articles 5, 6, 7, and 8), and subsequent amendments.<\/p>\n<p>Applications for Italian citizenship may also be submitted by foreign citizens who have entered into a civil union with an Italian citizen, granted that the union is registered in the Vital Records&#8217; Registry of the Italian Municipality where it took place (please consult these laws for additional information <a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:decreto.legislativo:2017-01-19;5\">Legislative Decree No. 5 of January 19, 2017<\/a>, and\u00a0 <a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:decreto.legislativo:2017-01-19;6!vig=\">Legislative Decree No. 6 of January 19, 2017<\/a>, and <a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:decreto.legislativo:2017-01-19;7!vig=\">Legislative Decree No. 7 of January 19, 2017<\/a>).<\/p>\n<p>A foreign spouse or civil union partner may acquire Italian citizenship upon the submission of an application, <a href=\"https:\/\/www.esteri.it\/en\/servizi-consolari-e-visti\/italiani-all-estero\/cittadinanza\/\"><u>provided the requirements established by current legislation are met<\/u><\/a>, as explained in the following sections.<\/p>\n<p>This procedure therefore applies in the following cases:<\/p>\n<ul>\n<li>marriage to an Italian citizen celebrated after April 27, 1983<\/li>\n<li>civil union with an Italian citizen duly registered in Italy<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>NOTE:<br \/>\nESSENTIAL CONDITIONS FOR THE APPLICATION OF THE PROCEDURE<\/strong><\/span><\/p>\n<p>In order to initiate the procedure for acquiring Italian citizenship by marriage (<em>iure matrimonii), <\/em>the following essential requirements must be met:<\/p>\n<ol>\n<li><strong>Residence within the consular jurisdiction<br \/>\n<\/strong>The application must be submitted to the <a href=\"https:\/\/ambwashingtondc.esteri.it\/en\/chi-siamo\/la-rete-consolare\/\">Consular Office territorially responsible for providing consular services based on the applicant&#8217;s residence<\/a>, exclusively through the dedicated online portal.<br \/>\nThe spouse or civil union partner who is an Italian citizen must be resident in the same consular jurisdiction, must be duly registered with AIRE, and must be cohabiting at the same address as the applicant. In the case of separate domicile, both spouses must provide appropriate documentation justifying its reason (e.g., work requirements, children&#8217;s education, medical care, or other proven needs).<\/li>\n<li><strong>Transcription and Validity of the Marriage or Civil Union<br \/>\n<\/strong>If the marriage or civil union was celebrated abroad, the marriage or civil union act must already have been transcribed into the Vital Records by an Italian municipality. The bond must remain valid until the decree granting citizenship is issued: as of the date of the decree, there must be no legal separation, dissolution, or divorce.<br \/>\nIn the event of death of the spouse after the application has been submitted, the right to Italian citizenship is not forfeited.<\/li>\n<li><strong>Criminal Status<br \/>\n<\/strong>Granting Italian citizenship is also subject to the absence of any of the following:<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Convictions issued by Italian judicial authorities for crimes punishable by more than three years of imprisonment;<\/li>\n<li>Convictions by foreign judicial authorities for non-political crimes punishable by more than one year;<\/li>\n<li>Convictions for crimes against the State;<\/li>\n<li>Preventative reasons related to the safety of the Italian Republic.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><em>Last update: March 30, 2026\u00a0<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"The acquisition of Italian citizenship by a foreign or stateless spouse who married an Italian citizen on or after April 27, 1983, is currently regulated by Law No. 91 of February 5, 1992 (Articles 5, 6, 7, and 8), and subsequent amendments.
