1) By decision of the Council of Ministers adopted on March 14, 2017, the date of May 28, 2017, has been set for two ABROGATIVE REFERENDA regarding the “abrogazione di disposizioni limitative della responsabilità solidale in materia di appalti” and the “abrogazione di disposizioni sul lavoro accessorio” (voucher). The Decree of the President of the Republic to summon elections was issued on March 15, 2017, and published in the Official Gazette on that same day.
2) Voters living abroad and registered with AIRE
Voters residing abroad and registered with AIRE (Register of Italians living abroad) will receive, as usual, the electoral package at their home address. If voters do not receive this package, they can always request a duplicate to the Consular Office of the voter’s jurisdiction. Please note that it is the citizen’s duty to inform the competent CONSULAR OFFICE of changes in his/her residential address.
However, voters who are registered with AIRE and plan to vote in Italy must send to the CONSULAR OFFICE that has jurisdiction according to their residence (Embassy or Consulate) a statement on plain paper that sets forth: first and last name, date and place of birth, place of residence, Italian municipality where they are registered as Italians living abroad, and the election for which the voter intends to exercise the option of voting in Italy.
Voters must date and sign the statement and attach a photocopy of their identity document (ID). Statement and ID copy may be sent by mail, fax, e-mail (certified or not certified), or hand-delivered to the CONSULAR OFFICE, also by an individual other than the voter, no later than March 25th, 2017, in other words within the ten days following the date of publication of the Decree of the President of the Republic of the summoning of the elections (in Official Gazette n. 62, March 15, 2017). A (non-binding) option statement form is attached.
Options for sending statements to vote in Italy to the Consular Office at the Embassy of Italy in Washington, D.C.
Voters registered with AIRE and residents in the consular district of the Embassy of Italy in Washington, D.C. (District of Columbia; in Maryland, only the counties of Montgomery and Prince George’s while all other counties fall under the jurisdiction of the Consulate General of Italy in Philadelphia; in Virginia, only the counties of Arlington and Fairfax, the City of Alexandria, the City of Falls Church, and the City of Fairfax, while all other counties fall within the jurisdiction of the Consulate General of Italy in Philadelphia) may submit their statements on the option to vote in Italy to the Consular Office by the aforementioned deadline (March 25th) as follows:
– By mail addressed to: the Embassy of Italy in Washington D.C., Consular Office, 3000 Whitehaven Street, NW, Washington, D.C. 20008;
– By email to: washington.referendum@esteri.it or to the PEC (certified) email address: amb.washington.consolare@cert.esteri.it ;
– By fax to: +1 (202) 518-2141;
– By hand-delivery: to the Consular Chancellery during the hours when it is open to the public: Monday to Friday from 10:00 am to 12.30 pm.
3) Voters temporarily abroad.
Italian voters who for reasons of work, study, or medical care are temporarily residing abroad for a period of at least three months which includes the date of the referendum, as well as family members who live in the same residence, will be able to register to participate in the vote by mail organized by the Italian Consular Offices (law 459 of 27 December 2001, as modified by Law of May 6, 2015, no. 52).
To participate in the vote abroad, voters who qualify shall mail said option statement TO THEIR MUNICIPALITY in Italy (the municipality where they are registered as voters) no later than APRIL 26, 2017 (voters who avail themselves of this option can revoke it by the above mentioned deadline.)
Statement options can be sent by mail, fax, e-mail (certified or not certified), or be hand-delivered to the Municipality also by an individual other than the interested person (see the web site www.indicepa.gov.it for the certified email addresses of Italian municipalities).
Voters must date and sign the option statement, written on plain paper, and attach a photocopy of their valid ID, must include the foreign residency mailing address where the ballot papers should be sent, the Consular Office that has jurisdiction on that territory, and a statement certifying that the voter meets the requirements for admission to voting by mail (meaning that the voter is temporarily – for reasons of work, study or medical care – residing in a foreign country where the voter is not a registered resident, for a period of at least three months which include the date of the referendum; or, that the voter is a family member sharing the same residence of a citizen in the situation described above). [Law 459 of 27 December 2001, paragraph 1 of art. 4 bis].
The option statement must be written in accordance with Articles 46 and 47 of the Decree of the President of the Republic of December 28, 2000, n. 445 (consolidating the legislative and regulatory provisions on administrative documentation), and with awareness of the criminal consequences of misrepresentation (art. 76 of the above-mentioned Presidential Decree 445/2000).
A specific option statement form that voters who are temporarily abroad may use to express their vote by mail will be provided as soon as possible.

REFENDUM POPOLARI DEL 28 MAGGIO: COMUNICATO INFORMATIVO
1. Con decisione del Consiglio dei Ministri adottata il 14 marzo 2017 è stata determinata la data del 28 maggio 2017 per i Referendum popolari relativi alla “abrogazione di disposizioni limitative della responsabilità solidale in materia di appalti” e alla “abrogazione di disposizioni sul lavoro accessorio” (voucher). Il Decreto del Presidente della Repubblica di convocazione dei comizi elettorali è stato emesso in data 15 marzo 2017 e pubblicato in Gazzetta Ufficiale nella stessa data.
2. ELETTORI RESIDENTI ALL’ESTERO ED ISCRITTI ALL’AIRE
Gli elettori residenti all’estero ed iscritti nell’AIRE (Anagrafe degli Italiani Residenti all’Estero) riceveranno come di consueto il plico elettorale al loro domicilio. Si ricorda che è onere del cittadino mantenere aggiornato il consolato circa il proprio indirizzo di residenza. Chi invece, essendo residente stabilmente all’estero, intende votare in Italia, dovrà far pervenire al consolato competente per residenza un’apposita dichiarazione su carta libera che riporti: nome, cognome, data e luogo di nascita, luogo di residenza, indicazione del comune italiano d’iscrizione all’anagrafe degli italiani residenti all’estero, l’indicazione della consultazione per la quale l’elettore intende esercitare l’opzione. La dichiarazione deve essere datata e firmata dall’elettore e accompagnata da fotocopia di un documento di identità del richiedente, e può essere inviata per posta, per telefax, per posta elettronica anche non certificata, oppure fatta pervenire a mano al consolato anche tramite persona diversa dall’interessato ENTRO IL 25 MARZO 2017, ovvero entro i dieci giorni successivi alla data di pubblicazione del Decreto del Presidente della Repubblica di convocazione dei comizi elettorali (in G.U. n. 62 del 15.03.2017). Si allega in proposito un modello (non vincolante) di opzione.
Modalità di invio delle dichiarazioni per il voto in Italia all’Ufficio consolare presso l’Ambasciata d’Italia in Washington D.C.
Le dichiarazioni di opzione per il voto in Italia degli elettori iscritti nell’AIRE e residenti nella circoscrizione consolare dell’Ambasciata d’Italia in Washington D.C. (Distretto di Columbia; nel Maryland, solo le Contee di Montgomery e Prince George’s mentre tutte le altre contee appartengono alla circoscrizione del Consolato Generale d’Italia a Filadelfia; in Virginia, solo le Contee di Arlington e Fairfax, la Città di Alexandria, la Città di Falls Church e la Città di Fairfax mentre tutte le altre contee rientrano nella circoscrizione del Consolato Generale d’Italia a Filadelfia) possono essere trasmesse all’Ufficio consolare entro il termine indicato con le seguenti modalità:
– per posta all’Ambasciata d’Italia in Washington D.C., Ufficio consolare, 3000 Whitehaven Street, NW, Washington, D.C. 20008;
– tramite posta elettronica all’indirizzo di posta washington.referendum@esteri.it oppure all’indirizzo di PEC
amb.washington.consolare@cert.esteri.it ;
– tramite fax al numero +1 (202) 518-2141;
– mediante consegna a mano presso la Cancelleria consolare negli orari di apertura al pubblico: dal lunedì al venerdì dalle ore 10 alle ore 12.30.
3. ELETTORI TEMPORANEAMENTE ALL’ESTERO (MINIMO TRE MESI)
Gli elettori italiani che per motivi di lavoro, studio o cure mediche si trovano temporaneamente all’estero per un periodo di almeno tre mesi, nel quale ricade la data di svolgimento della consultazione elettorale, nonché i familiari con loro conviventi, possono partecipare al voto per corrispondenza organizzato dagli uffici consolari italiani (legge 459 del 27 dicembre 2001, quale modificata dalla legge 6 maggio 2015, n. 52).
Tali elettori, se intendono partecipare al voto dall’estero, dovranno far pervenire AL COMUNE d’iscrizione nelle liste elettorali ENTRO IL 26 APRILE 2017 (con possibilità di revoca entro lo stesso termine) una dichiarazione di OPZIONE.
L’opzione può essere inviata per posta, per telefax, per posta elettronica anche non certificata, oppure fatta pervenire a mano al comune anche da persona diversa dall’interessato (nel sito www.indicepa.gov.it sono reperibili gli indirizzi di posta elettronica certificata dei comuni italiani).
La dichiarazione di opzione, redatta su carta libera e obbligatoriamente corredata di copia di documento d’identità valido dell’elettore, deve in ogni caso contenere l’indirizzo postale estero cui va inviato il plico elettorale, l’indicazione dell’ufficio consolare (Consolato o Ambasciata) competente per territorio e una dichiarazione attestante il possesso dei requisiti per l’ammissione al voto per corrispondenza (ovvero di trovarsi per motivi di lavoro, studio o cure mediche in un Paese estero in cui non si è anagraficamente residenti per un periodo di almeno tre mesi nel quale ricade la data di svolgimento della consultazione elettorale; oppure, di essere familiare convivente di un cittadino che si trova nelle predette condizioni [comma 1 dell’art. 4-bis della citata L. 459/2001]). La dichiarazione va resa ai sensi degli articoli 46 e 47 del decreto del Presidente della Repubblica 28 dicembre 2000, n. 445 (testo unico delle disposizioni legislative e regolamentari in materia di documentazione amministrativa), dichiarandosi consapevoli delle conseguenze penali in caso di dichiarazioni mendaci (art. 76 del citato DPR 445/2000).
Si fa riserva di fornire un apposito modello di opzione che potrà essere utilizzato dagli elettori temporaneamente all’estero che intendono ivi esprimere il voto per corrispondenza, non appena disponibile.
